Parents who pulled their son out of Torrington schools and placed
him in a private school in Waterbury are planning to sue the city
and Board of Education. An intent to sue notice has been filed with
the city.

Joanne and Matthew Avoletta, who complained about air quality and
mold problems at Torrington Middle School starting in 2003, are
claiming that Torrington failed to provide their youngest son with a
free, appropriate public education as required by law when the
district refused to pay for him to attend a different school.

The Avolettas claim that because of pre-existing medical conditions
exacerbated by substandard air quality, poor ventilation and a leaky
roof, their youngest son, Matthew, now 16, could not attend
Torrington Middle School or Torrington High School. He currently
attends Chase Collegiate School in Waterbury.
