The toxic chemicals produced naturally by molds are some of the most lethal poisons on earth - thus, their use as agents of biological warfare. Though it is a long, hard, expensive battle to undertake, teachers, school staff, and students exposed to biotoxins can receive (usually inadequate) compensation for their injuries and schools can be forced to test and remediate properly by courts, in some cases. In the general absence of laws regulating the safety of school environments (pertaining to moisture and mold) the local battleground can sometimes involve litigation and worker's compensation courtrooms, in addition to attention from the local media and occasional local or state legislative bodies. We expect that the future will bring laws to protect children and school staff from being forced to attend or work in clearly unhealthy buildings. (SMH)

With all of the blessings of the industrialized world that we have built, comes the curse of toxicity of our air, water, food, homes and bodies. Some of these toxins, including toxic mold, poisonous cosmetics , chemicals, asbestos , radiation, pesticides, and lead paint , can cause serious illness like cancer, and even death.


The machines of our industrialized system release these toxins into the air, water and ground. This can lead to multiple health risks once people come into contact with these toxins in their everyday lives. Invisible to the naked eye, there isn’t much that can be done to minimize the risk of exposure to harmful toxins .


Preventing the spread and use of harmful materials falls to the U.S. Government to enforce regulations which are in place to protect the general public. There are also ways for average citizens to fight for their rights, the best way being in the court room.


Years can go by before discovery of a toxic injury is discovered. The injured party will also have to go up against corporations and other polluting organization that have vast resources to wage war in court. These factors make toxic tort litigation a complicated process.


But that should not discourage an injured party from enforcing their rights. Remember films like Erin Brockovich and A Civil Action ? Those films are based on ordinary people doing extraordinary things to protect their rights! If you have been injured by a toxic tort, you owe it to yourself to fight for the compensation that you deserve.
